COURT REPORT: More Settlements—and One ‘Framework’—Announced

Editor’s note: The COURT REPORT is RISMedia’s weekly look at current and upcoming lawsuits, investigations and other legal developments around real estate.

As many lawsuits persist across the real estate industry, more and more settlements are in the works and being reached in order to bring an end to the madness.

Here is a look at some of the settlement updates this past week:

NextHome settles in Burnett copycat case

Another real estate company has joined the list of those who have settled in the Gibson case—in a Burnett copycat also filed by attorney Michael Ketchmark.

Not originally named in the case, NextHome was added to Gibson as a defendant back in April.

Any dates or deadlines in the case have been paused following the joint statement that the parties reached “a settlement in principle.”

Details were not immediately available as far as any payment made or practice changes agreed to.

The agreement now waits for final approval from a judge.

Maslanka agrees to framework for settlement

Maslanka vs. Baird & Warner, Inc., continues to mediate and negotiate a settlement.

In a joint status report last week, both parties agreed “as to a framework for a settlement that, if finalized, will resolve this matter in its entirety,” as the filing states.

The case has been stayed while the parties go through settlement negotiations via in-person mediation, which has occurred April 16 and Aug. 1 so far.

The case will remain stayed, with another joint status report due within 60 days or by Nov. 11, 2024.
